Waiver, Release of Liability, and Assumption of Risk Agreement

In consideration of being permitted to enter and participate in the haunted house attraction, walk-through, or related event operated by The Curley's Haunt (“Operator”), located at 4737 Concord Pike, Ste 510, Wilmington, DE 19803 (the “Attraction”), I, the undersigned participant, agree to the following terms:

1. Description of Risks

I understand that the Attraction is an interactive haunted-house-style entertainment experience that may include, without limitation: darkened or dimly lit rooms and hallways; strobe lighting, fog, smoke, and haze effects; loud or sudden noises; uneven, narrow, wet, or obstructed walking surfaces; low ceilings, stairs, ramps, and tight or enclosed spaces; simulated violence, gore, and frightening imagery; live actors who may approach, startle, chase, or engage participants; special effects including air blasts, vibrations, moving set pieces, and animatronics; and physical exertion including walking, crouching, and moving quickly. I understand that these conditions are intended to be startling and disorienting and can cause a person to react in unpredictable ways, including running, falling, tripping, or colliding with objects, walls, actors, or other participants.

2. Assumption of Risk

I understand that participation in the Attraction carries inherent risks of physical injury, psychological or emotional distress, and, in rare cases, death, and that these risks cannot be eliminated regardless of the care taken by the Operator. I voluntarily and knowingly assume all such risks, known and unknown, whether arising from the negligence of the Operator or otherwise, and whether occurring before, during, or after my time inside the Attraction, including in queue lines, parking areas, and outdoor grounds.

3. Release and Waiver of Liability

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue the Operator and its owners, officers, employees, agents, actors, volunteers, contractors, and property owners/landlords (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me, or to any property belonging to me, while participating in the Attraction, whether caused by the negligence of the Released Parties or otherwise, except to the extent caused by the Released Parties' gross negligence or willful misconduct where such limitation is not permitted by law.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that they may incur due to my participation in the Attraction, whether caused by my own negligence or the negligence of others.

5. Rules of Conduct

• I will not touch, strike, grab, or otherwise physically contact actors, staff, or other participants.
• I will not bring weapons, alcohol, illegal substances, open flame, or recording devices unless expressly permitted.
• I will follow all posted signage and instructions from staff and exit immediately if directed to do so.
• I will notify staff immediately of any medical condition, injury, or need to exit the Attraction.

6. Health Acknowledgment

I represent that I am in good health and have no medical condition — including but not limited to heart conditions, seizure disorders, asthma or respiratory conditions, mobility impairments, pregnancy, or anxiety-related conditions — that would make my participation in the Attraction unsafe. I understand that the Attraction uses strobe lighting, fog/haze, and loud sound effects. I acknowledge that it is my sole responsibility to determine whether I am fit to participate.

7. Right to Refuse or Remove

The Operator reserves the right to refuse entry or to remove any person from the Attraction, without refund, for failure to follow rules or for behavior that endangers themselves, other participants, actors, or staff.

8. Photo, Video, and Media Release

I grant the Operator permission to photograph and/or record me while on the premises and to use such images or footage for promotional or commercial purposes, without compensation to me. Participants who do not wish to be recorded must notify staff before entering the Attraction.

9. Severability and Governing Law

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

10. Acknowledgment

By entering and participating in the Attraction, I acknowledge that I have read and understand this Waiver, Release of Liability, and Assumption of Risk Agreement, that I am giving up substantial legal rights as described above, and that I accept these terms voluntarily and of my own free will as a condition of entry. If I am entering on behalf of a minor in my care, I accept these terms on the minor's behalf as well as my own.
