I. Introduction

Welcome to The Curley’s Haunt! Before entering, please read this Waiver carefully. By signing (or clicking “I Agree”), you and the people in your group acknowledge that you have read, understood, and voluntarily agreed to all terms.

II. Acknowledgment of Risks

1. Participation may involve darkness, strobe lights, fog, loud noises, uneven flooring, and startling elements. 2. Risks include slips, trips, falls, scrapes, bruises, sprains, panic attacks, seizures, allergic reactions, and emotional distress. 3. You acknowledge potential incidental contact with actors, props, and set pieces. 4. You certify you are not pregnant, epileptic, asthmatic, or otherwise medically restricted, and are not under the influence of drugs or alcohol.

III. Release of Liability

READ CAREFULLY: In consideration of entry, you release and forever discharge 302 Frights LLC, its owners, agents, employees, contractors, affiliates, successors, and assigns from any and all liability, claims, demands, or causes of action arising out of your participation, INCLUDING BUT NOT LIMITED TO CLAIMS BASED ON NEGLIGENCE. This includes personal injury, property damage, and emotional distress. This release does not apply to gross negligence or intentional misconduct.

IV. Assumption of Risk

You voluntarily assume all risks associated with participation and acknowledge that you may exit at any time. You agree to follow staff instructions and refrain from unsafe behavior.

V.Indemnification

You agree to indemnify, defend, and hold harmless 302 Frights LLC against any claims or damages brought by third parties arising from your conduct or participation.

VI.Consent to Medical Treatment

In the event of illness or injury, you consent to emergency medical treatment deemed necessary and agree to be financially responsible for related costs.

VII.Consent to Use of Likeness

You grant 302 Frights LLC a perpetual, worldwide, royalty-free license to use photographs, video, or audio recordings of you for promotional purposes in any media, without further approval or compensation.

VIII.No Refund Policy

Tickets are non-refundable. Leaving due to fear, distress, or personal choice does not entitle you to a refund.

IX. Rules of Conduct

Unsafe, aggressive, or disruptive behavior may result in removal without refund. Participants must comply with all posted and verbal rules.

X. Electronic Agreement

By clicking “I Agree” online, you consent to the use of electronic signatures under the ESIGN Act and affirm that your agreement is legally binding.

XI. Severability

If any part of this Waiver is found unenforceable, the remaining provisions remain in effect.

XII. Governing Law & Venue

This Waiver is governed by Delaware law. Any disputes must be resolved exclusively in Delaware state or federal courts, unless otherwise subject to binding arbitration as determined by 302 Frights LLC.

XIII. Agreement to Terms

By signing below or clicking “I Agree,” you affirm that you have carefully read, understood, and voluntarily accepted this Waiver.

XIV. Parental Consent (if under 18)

I am the parent/legal guardian of the participant and consent to all terms of this Waiver on behalf of the minor.
