User Agreement for Account Holders and Volunteers

1. Purpose and Scope

This User Agreement (“Agreement”) applies to anyone who creates a registered account on https://www.thecurleyshaunt.com/ (the “Site”) and/or applies for, is accepted into, or participates in The Curley's Haunt volunteer program (the “Volunteer Program”), operated by The Curley's Haunt, 4737 Concord Pike, Ste 510, Wilmington, DE 19803 (“Company,” “we,” “us,” or “our”). This Agreement supplements, and does not replace, our Terms of Service and Privacy Policy, both of which continue to apply. In the event of a direct conflict between this Agreement and the Terms of Service regarding account holders or volunteers specifically, this Agreement controls; in all other respects, the Terms of Service and Privacy Policy govern. By creating an account, submitting a volunteer application, or participating in the Volunteer Program, you (“User,” “you,” or “your”) agree to this Agreement.

2. Eligibility

You must be at least 18 years old to register for an account or apply as a volunteer. We do not accept account registrations or volunteer applications from individuals under the age of 18. We reserve the right to request proof of age and to decline or terminate any account or application that does not meet this requirement.

3. Account Holder Rights and Responsibilities

As a registered account holder, you have the right to access the features made available to your account type, update your own profile information, and request deletion of your account as described in our Privacy Policy. In turn, you agree to:

• Provide accurate, current information and keep it up to date;
• Maintain the confidentiality of your login credentials and not share your account with others;
• Use the account only for lawful purposes consistent with this Agreement and our Terms of Service;
• Notify us promptly at info@thecurleyshaunt.com of any suspected unauthorized use of your account.

4. General Code of Conduct

All account holders and volunteers agree to treat guests, fellow volunteers, actors, and staff with respect. You agree that you will not, in connection with your account or your participation in the Volunteer Program:

• Engage in harassment, discrimination, intimidation, or abusive behavior toward any guest, volunteer, actor, or staff member on the basis of race, color, religion, sex, national origin, age, disability, sexual orientation, gender identity, or any other status protected by law;
• Engage in or threaten physical violence, or use physical contact with guests beyond what is authorized as part of an approved scare role;
• Possess or be under the influence of alcohol or illegal drugs while on Attraction premises or performing volunteer duties;
• Bring weapons, open flame, or unauthorized props onto Attraction premises;
• Engage in conduct that could reasonably endanger the safety of guests, volunteers, actors, or staff;
• Misrepresent your identity, age, or affiliation with the Company;
• Use your account or volunteer status to solicit, advertise, or sell unrelated goods or services.

Violation of this Code of Conduct may result in immediate removal from Attraction premises, suspension or termination of your account or volunteer status, and, where warranted, referral to law enforcement.

5. Volunteer-Specific Terms

a. Nature of the Relationship. Volunteers donate their time and services to the Company on a purely voluntary basis. Volunteers are not employees, agents, joint venturers, or independent contractors of the Company, are not entitled to wages, overtime, benefits, or workers' compensation coverage (except where required by applicable law), and have no authority to make representations or enter into agreements on behalf of the Company.

b. Acceptance and Screening. Submitting a volunteer application does not guarantee placement. We may require an interview, training session, and, where applicable and with your separate written consent, a background check before you are approved to volunteer, particularly for roles involving contact with minors or positions of trust.

c. Training and Supervision. Volunteers must complete any required safety and role-specific training before participating and must follow the direction of on-site supervisors and staff at all times, including immediate instructions to stop an action, exit a scene, or leave the premises.

d. Scheduling and Attendance. Volunteers agree to honor their scheduled shifts or provide reasonable advance notice of cancellation through the process designated by the Company. Repeated no-shows or late cancellations may result in removal from the Volunteer Program.

e. Costumes, Makeup, and Equipment. Any costumes, makeup, props, or equipment provided by the Company remain the Company's property and must be returned in the condition provided, ordinary wear excepted. Volunteers are responsible for any loss or damage caused by their negligence or misuse.

f. Physical Demands and Health. Volunteer roles may require standing, walking, crouching, or repetitive movement for extended periods in low-light, fog, or high-noise conditions. Volunteers are responsible for informing their supervisor of any condition that may affect their ability to safely perform their role and for taking breaks as needed.

g. Separate Waiver Required. All volunteers must sign the Company's volunteer liability waiver before participating in any on-site training or shift. That waiver is a separate document and is incorporated into this Agreement by reference.

6. Confidentiality

In the course of using certain account features or participating in the Volunteer Program, you may learn non-public information about the Attraction, including scare sequences, special effects, technical or safety systems, staffing plans, and other operational details (“Confidential Information”). You agree not to disclose Confidential Information to any third party, and not to post, stream, or share photos, video, or descriptions of behind-the-scenes areas, scare mechanics, or unreleased attraction elements on social media or elsewhere, without the Company's prior written consent. This obligation continues after your account is closed or your volunteer participation ends.

7. Content and Communications

Any photos, videos, messages, or other content you submit through your account, in connection with the Volunteer Program, or that we capture of you while volunteering at the Attraction, may be used by the Company for internal training, promotional, and marketing purposes as described in our Terms of Service and Privacy Policy. If you do not wish to be photographed or recorded while volunteering, notify your supervisor before your shift begins.

8. Suspension and Termination

We may suspend or terminate your account, your volunteer status, or both, at any time, with or without notice, for violation of this Agreement, our Terms of Service, the Code of Conduct in Section 4, or for any conduct we determine, in our sole discretion, to pose a risk to guests, volunteers, actors, staff, or the Attraction. You may resign from the Volunteer Program or close your account at any time by notifying us at info@thecurleyshaunt.com. Sections of this Agreement that by their nature should survive termination — including Confidentiality, Indemnification, and Dispute Resolution — will survive.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owners, officers, employees, agents, and contractors from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your breach of this Agreement, your conduct as an account holder or volunteer, or your violation of any rights of a third party.

10. Relationship to Other Agreements

This Agreement works together with, and does not replace, our Terms of Service, Privacy Policy, and any liability waiver you sign in connection with visiting or volunteering at the Attraction. Provisions of our Terms of Service regarding disclaimers, limitation of liability, arbitration (if applicable), and governing law apply equally to this Agreement.

11. Governing Law

This Agreement is governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, consistent with the governing law provision in our Terms of Service.

12. Changes to This Agreement

We may update this Agreement from time to time. If we make material changes, we will revise the “Last Updated” date above and, where appropriate, provide additional notice, such as an email to account holders or an announcement to active volunteers. Continued use of your account or continued participation in the Volunteer Program after changes become effective constitutes your acceptance of the revised Agreement.
